The ongoing legal battle between two-wheeler giants Bajaj Auto and TVS Motor has taken yet another turn. A division bench of Madras High Court on Thursday suspended the order issued by justice R Banumathi on Wednesday in the patent infringement case filed by Bajaj Auto, with regard to the new ‘TVS Flame’ bike.

Following an appeal filed by TVS-M on Thursday against the order that restrained the company from booking or selling the Flame brand of bikes, a bench consisting of chief justice AP Shah and justice Rama Subramanian suspended the order. The bench has adjourned further hearing to January 4 and 5.

The judges said the defendant should file a counter-affidavit and the matter should be heard in detail before an injunction order is passed.

In November this year, TVS-M had filed a groundless threat of legal proceedings suit against Bajaj Auto and this case has also been adjourned to January 4 and 5. Both the cases will be heard together, according to AA Mohan of Mohan Associates, representing Bajaj Auto.

As regards the patent infringement case filed by Bajaj Auto, TVS would have to file its counter-affidavit by December 31 while Bajaj Auto would file its rejoinder by January 3, he added.
